EU Data Act
The EU Data Act is a European Union regulation that aims to create a fair and innovative data economy by increasing data availability and establishing rules for access and use across the EU. It enables users of connected devices, particularly Internet of Things (IoT), and businesses to share generated data with third parties for various purposes, including service improvement and new application development. Additionally, it simplifies the process of switching Cloud Service Providers (CSP) and data processing services. The Data Act took effect in January 2024 and applies from 12 September 2025 onwards.
Atlassian’s commitment to EU Data Act compliance
Atlassian supports its EU customers with a strong contractual framework, compliance attestations, and transparency regarding our operational and security practices. The EU Data Act sets requirements on service providers to facilitate and support customers who want to exit their cloud services. To that extent, the EU Data Act requires service providers to have an Exit Plan and to clearly communicate data portability options and the steps users must take to exercise their rights. Service providers are also responsible for implementing the necessary security measures to protect customer data during the retrieval process.
Shared responsibility in compliance
These requirements, like most regulatory frameworks, involve shared responsibility. Atlassian provides tools, documentation, and contractual commitments that align with the EU Data Act’s principles, and customers remain accountable for using the available options to exercise their rights. Atlassian enables customers to export their data at anytime. Appreciating that exporting data or completing migrations can be a lengthy process, we advise customers to initiate these activities in a timely manner in order to achieve their desired outcomes before the end of a subscription term. We encourage customers to review the Atlassian Customer Agreement, utilise our publicly available resources, and engage with our teams to understand how Atlassian’s controls and practices support the EU Data Act requirements.
